Sedgwick Launches the Digital Media Law Blog

July 2011

Our newest blog offering, the Digital Media Law Blog, provides timely and relevant information regarding the rapidly changing world of digital media. As digital media is a vast and expansive topic, we will approach this undertaking from many different angles, including analysis and discussion of recent developments in marketing, intellectual property, social media and privacy and data security issues, as well as "more traditional" media issues involving First Amendment and freedom of speech claims.  Our contributors draw on different practice areas and backgrounds and provide unique perspectives on the legal issues facing companies operating in the digital age.
 
The blog will cover myriad topics related to digital media, privacy and the like, including:
 
FTC Pronouncements & Actions – The Federal Trade Commission (FTC) has been extraordinarily active policing the Internet for unfair or deceptive practices, particularly those related to digital marketing and privacy, among others.  In addition, the FTC frequently issues guidelines to address the legal issues attendant to nascent technologies.  The blog will report and discuss FTC action involving digital media and privacy, as well as advise on the implications of those actions for companies operating in the digital world.
 
Privacy & Data Security – Privacy is an extremely hot button issue, with a new piece of federal legislation seemingly introduced every day.  The blog will help readers stay current on the numerous statutory proposals and laws as well as on best practices for securing confidential information and for mitigating risk.  Our attorneys regularly handle various privacy and data security matters, including counseling on all aspects of privacy laws (including breach notification requirements), drafting and advising on privacy policies, as well as agreements regarding third-party protection of clients' customer data and representing clients in federal and state court in litigation and investigations regarding their privacy and data security practices.
 
Consumer Class Actions – Sedgwick has defended a wide array of companies in consumer class actions in the digital space, including mobile marketing claims brought under the Telephone Consumer Protection Act and privacy claims brought under various statutory and common law theories.  Our attorneys have defeated class certification outright in a number of recent cases, and obtained favorable settlements for our clients in a number of others.
 
New Media Marketing – The digital media landscape is a rapidly evolving one.  Our attorneys have considerable expertise in this new and emerging media landscape.  We partner with our clients to leverage these new media and social networking technologies to help them achieve their goals.  The blog will be a valuable resource in assisting our clients and readers to stay abreast of the legal and regulatory issues governing new media.
