Prior to entering private practice, Mr. Covey successfully prosecuted numerous homicide cases as an assistant district attorney in Kings County, New York.
Trial Experience
Mr. Covey has tried more than 50 cases to verdict, the majority involving complex medical issues, including pharmaceutical products, medical devices and catastrophic injury cases. These trials have taken place in New York and other states.
Recent and Present Litigation Engagements
- Mr. Covey recently acted as lead counsel for a major pharmaceutical company in an MDL venued in the United States District Court for the Western District of West Virginia involving several class actions and more than 2400 opt outs. The drug at issue was an anti-depressant associated with liver damage. The client elected to withdraw the drug from the market and wished to pursue early resolution. Mr. Covey and the firm were able to negotiate early settlement on favorable terms and to conclude the litigation within a very short time frame without trial or significant discovery of company witnesses.
- Mr. Covey is National Counsel for a major pharmaceutical company with respect to its antibiotic and DES litigations.
- Mr. Covey is National Counsel for another pharmaceutical company in the Average Wholesale Price litigation.
- Mr. Covey represents a major medical device manufacturer in a putative class action concerning surgical hardware pending in the United States District Court for New Jersey.
- Mr. Covey is National Counsel for a chemical company in the MTBE MDL pending in the United States District Court for the Southern District of New York.

Mr. Covey has been recognized by his peers as an outstanding trial lawyer, having been inducted into the American Board of Trial Advocates and the International Academy of Trial Attorneys. He belongs to the Defense Research Institute, The New York Bar Association and the Federation of Defense and Corporate Counsel. He has been listed for the last several years in Best Lawyers in America and Best Lawyers in New York.
