London & Bermuda Newsletter
Winter 2009/2010
In this Issue:
The London section of this issue of Sedgwick's London & Bermuda Newsletter first overviews changes to the UK legal system. Then we consider recent decisions in the UK which may signal a trend in encouraging "self-reporting", which could raise difficult questions for commercial insurers. Our next article addresses the liability of auditors in claims of negligence, followed by an article which examines the "without prejudice" principle and settlement disputes. We then review a rare case, where an "irregularity" appeal of an arbitration came before the courts. We also discuss a new bill which proposes a change to an injured third party's right to sue the insurer of the responsible party in the context of a bankruptcy or insolvency. Our last article for the London Update reviews how the English Commercial Court has cut through the Gordian knot of the London Market excess of loss (LMX) spiral.
Our Bermuda Update examines the new legal theories appearing in the forum of fund-related litigation, and their relationship to longstanding and established principles.
