Insurer v. Insured Contractor

Sedgwick obtained a declaratory judgment on behalf of our insurance client in a coverage dispute arising out of a construction defect action.  Prior to participating in discovery, Sedgwick filed for summary judgment, arguing that the CGL policies our client issued did not provide coverage for defective construction workmanship. Granting our motion, the court held that our client owed no duty to defend or indemnify the insured and denied the insured’s request to hold the motion in abeyance pending the taking and completion of discovery.
