Workers' Compensation

November 2006

Sedgwick successfully argued before the California Court of Appeal, on behalf of the insurance industry, that a state law requiring payment of a workers' compensation death benefit to the estates of employees, who die without dependents, is unconstitutional.  By striking down the Labor Code death-without-dependents statute, the opinion will save insurers and self-insured employers millions in duplicate and illegal payments.
