Plaintiff v. Construction and Mining Equipment Company

February 2008

Sedgwick obtained a dismissal for our client, a major manufacturer of construction and mining equipment, in a products liability and asbestos case filed in King County Superior Court in Washington. Plaintiff alleged that his illness was caused by his exposure to asbestos during his 22-year career as a mechanic in the military, where he worked on diesel engines manufactured by our client. On the eve of trial, the Sedgwick team won a detailed ruling from the trial court that precluded plaintiffs’ experts from testifying. After the ruling, plaintiff dismissed our client.
