Plaintiff v. Automobile Manufacturer

Sedgwick won a motion to dismiss and summary judgment in the Central District of California, then successfully obtained an appellate decision affirming those rulings in the Ninth Circuit Court of Appeals. Plaintiff filed a class action against our client, a vehicle manufacturer, alleging breach of express and implied warranties, fraud and violation of Business and Professions Code 17200 in connection with the sale of vehicles that the plaintiff alleged contained defective head gaskets. Sedgwick obtained a dismissal of the warranty claims and summary adjudication of the fraud and Section 17200 claims. Plaintiff appealed all rulings, and Sedgwick successfully argued before the Ninth Circuit Court of Appeals, which affirmed the judgment in our client's favor.
