Employee v. Major Paints and Coatings Manufacturer
Sedgwick earned a bench trial verdict for our client, a major manufacturer of paints and coatings, during an administrative trial before the Labor commissioner. The plaintiff, an employee, alleged that he was entitled to a retention bonus that had been offered by our client more than a decade earlier. Sedgwick argued that the plaintiff was not eligible for the bonus because he was not an eligible employee by virtue of a promotion, and because the company had discontinued this particular bonus before anyone had vested. Sedgwick prevailed based on company witness testimony and cross-examination of the plaintiff and his witness.
