Plaintiff v. Major Newspaper

Sedgwick obtained a dismissal on behalf of our client, a major national newspaper, in an action filed in state district court in Texas. The plaintiff, who was incarcerated for his participation in a Federal Emergency Management Agency fraud scheme, asserted that our client allegedly made defamatory statements in a 2006 published article on Katrina federal aid program fraud. Sedgwick successfully obtained summary judgment because the plaintiff’s claims were barred by a one-year statute of limitation. The plaintiff appealed, and Sedgwick argued that the appeal was untimely. The Court of Appeals agreed and dismissed the case for lack of jurisdiction.
