Plaintiff v. Utility Company

Sedgwick obtained a judgment in favor of its client, a utility company, in the amount of $40,427 in a personal injury action filed in state court in California. Before trial, the plaintiff demanded $1 million and Sedgwick served a statutory offer to compromise in the amount of $80,000. During trial, defense counsel argued that the plaintiff caused the incident, and his subsequent physical condition and hospitalizations were unrelated to the incident. The jury returned a verdict finding the total damages were $46,917 and the plaintiff was 50 percent at fault and therefore entitled to half of that amount. Following post-trial motions, the court awarded our client $63,885 in expert fees and costs, resulting in the entry of an amended judgment in our client’s favor.
