Plaintiff v. Surety Company

Sedgwick obtained a hard-fought victory on behalf of our client, a surety company, in a bench trial in state court in California that involved three cases with a boring subcontractor. In July, Sedgwick won a summary judgment on the boring subcontractor’s payment bond claim. The summary judgment motion defeated about $1.5 million in potential liability against our client, and gave our client a right to attorneys’ fees and costs. In round two of the same case, our client established a superior right to $77,000 in funds on deposit with the court, plus a further right to related attorneys’ fees. The total net turnaround for the client was more than $1.6 million.
