General Contractor v. Owner/Developer
Sedgwick acted as co-counsel in the representation of an owner/developer of a 10-unit luxury condominium project in West Los Angeles in a binding arbitration. The general contractor sought an order compelling the payment of his final pay application for $428,000, an additional $176,000 for related delay damages and reimbursement of a construction bonus, along with an additional $106,000 in interest per the contract. Our client submitted a counterclaim, seeking an arbitration award granting the owner the right to retain the withheld funds, plus additional damages for construction delay and the cost to repair construction defects. The arbitrator issued an award in which he denied all of the contractor’s claims and awarded our client the retained funds of $428,000, along with an additional $222,495 for repair to construction defects and delay–related damages, along with attorneys’ fees (to be determined).
