Framing and Drywall Subcontractor v. General Contractor

February 2012

Sedgwick obtained a favorable mediated settlement on behalf of our client, a framing and drywall subcontractor, in California state court. Our client alleged breach of contract (in unpaid contract funds), disruption and lost productivity on labor against the defendants, a general contractor and its bonding company.  The general contractor cross-claimed for alleged delays and back-charges.  At mediation, the contractor dropped all cross-claims and paid all subcontract balances, plus a large portion of the inefficiency claim, fees and costs. The total recovery for the client was $700,000.  The alternative fee structure employed for this matter provided an additional win for the client.  The fee agreement allowed the client to significantly reduce its expenses while litigation was pending.
