Plaintiff v. Chemical Company

Sedgwick obtained summary judgment on behalf of our client, a chemical company, in California state court. The plaintiff alleged that he developed mesothelioma as a result of his exposure to asbestos-containing products while working for several decades in construction.  The plaintiff alleged that he purchased asbestos-containing joint compound and stucco from retail stores owned by our client.  We successfully obtained summary judgment in favor of our client based upon the plaintiff's inability to establish the material element of causation – namely, the plaintiff lacked competent, admissible evidence that he was exposed to asbestos from any product purchased from our client's retail stores.
