Plaintiff v. Global Engineering and Construction Contractor

April 2012

Sedgwick obtained a favorable appellate ruling on behalf of our client, a global engineering and construction contractor and power equipment supplier, in a product liability case.  Our client was sued for the wrongful death of a refinery worker purportedly caused by the decedent's exposure to asbestos and asbestos-containing products that were applied to the exterior of equipment the client manufactured.  The trial court dismissed the complaint finding that our client had no duty to warn of the harm caused by external insulation attached to its product that it did not design, make or sell. The appellate court affirmed the trial court's decision.
