Plaintiff v. Heavy Equipment Manufacturer

Sedgwick obtained an order vacating a prior discovery ruling in an asbestos case that would have required our client, a heavy equipment manufacturer, to provide documents for all of its equipment in Florida. Based on how records are kept, this would have required production of records for customers all over the United States. After Sedgwick moved for a rehearing, in a historic decision, the court vacated its prior ruling in toto, holding that the discovery requests were improper and that no documents would need to be produced.  This ruling will not only benefit our clients but all asbestos defendants in the South Florida asbestos litigation arena going forward.  The decision has been lauded by asbestos defense counsel in Florida.  Defendants will now only be required to respond to discovery requests narrowly tailored to the facts of the individual cases.
